Our debt recovery instructions are received from small and large businesses across various sectors as well as from individuals who may have advanced funds through personal loans or some form of family arrangement.  With significant experience and a strong expertise in litigation, we strive to ensure that our debt recovery service is fast, efficient and economical.

Details of Illustrative Charges

We appreciate that the fees involved in debt recovery are important to you. We review our fees on a regular basis, taking into consideration our client’s feedback so that we can ensure we continue to offer a cost-effective debt recovery service.

In undisputed debt matters we can work for you on a fixed fee basis.  This means that you will know what the fees will be for your transaction from the outset. If during the debt recovery process the matter becomes disputed or enforcement action is required (for example, where you need to appoint a bailiff), you are informed of any change in the level of our fees.

You can in certain circumstances claim interest and costs compensation and we will advise you of the applicable interest rates and when compensation might be capable of being claimed, in addition to the debt owed.

Our fee includes:

  • Taking your instructions and reviewing your documentation
  • Undertaking as appropriate searches and due diligence against the debtor
  • Sending a formal Letter before Court Action compliant with the Court protocols
  • Recovering payment and accounting to you, or in the absence of payment seeking your instructions to draft and issue the court claim
  • In the absence of an Acknowledgment of Service or Defence being received, applying to the court to enter Judgement in default
  • When Judgement in default is received, serving it upon the debtor to demand payment
  • Accounting to you if payment is recovered, or providing you with customised advice on the best suited enforcement option and the associated likely costs to enforce payment of your judgment

Court Claims

These costs would apply where two unpaid invoices, (which are not disputed) are the subject of our recovery action and enforcement action is not required, following our securing a County Court Judgment and payment is recovered. If the debtor were to raise a genuine/significant dispute to your claim, or file a defence, we will discuss with you what additional work is required, to optimise your prospects of a successful recovery and provide you with appropriate costs advice as necessary. This may involve proceeding under a fixed fees relationship, or by raising charges at an hourly rate should, more time intensive work be required.

NB. The above court fees are subject to review by HM Courts and Tribunals Service

Exclusions

Anyone wishing to proceed with a claim should also note that:

The VAT element of our fee cannot be reclaimed from your debtor.
Interest and compensation may take the debt into a higher banding, with a higher cost.
The costs quoted above are not for matters where further enforcement action, such as a bailiff or a High Court Enforcement Officer is needed to enforce your judgment debt.

Whilst our fees are fixed and include those items detailed above there may be unforeseen factors which could increase fees charged. Where there is likely to be any additional cost, we will make sure you are informed of this at the earliest opportunity and provide you with a clear estimate of any additional fees that might be incurred. We would also advise you as to the extent of those further legal costs and fees which could be recovered from the debtor to make the recovery exercise as cost effective as possible.

Time Scales

A typical uncontested debt recovery claim will take between 2-12 weeks, from instruction through to Judgment. This may be quicker or longer, depending on whether we are required to issue a claim, how quickly matters are processed through the courts and whether the other side pay promptly on receipt of any Judgment by a court. As indicated above, should enforcement action be required, we will discuss our anticipated fees and the estimated timescales involved.  The matter will take longer to resolve depending on a number of factors such as the enforcement routes taken, the defendants reaction to them and inter-acting with   the court office and other agencies.
